Kennelly: The temporary restraining order in this case expires on 2/2/2026, as that is the longest a TRO may extend in this Circuit (by Rule and Circuit precedent) without being converted to a preliminary injunction. The Court has made it clear to plaintiff from the get-go that it would deny entry of a preliminary injunction if there was an insufficient interval between electronic service of summons/process (not just service of the TRO) and the preliminary injunction hearing. Despite this, plaintiff inexplicably waited until yesterday, 1/28/2026, to obtain summons, and the docket does not reflect completion of service yet. Regardless, any service now, even today, would be only 5 days before the preliminary injunction hearing, which the Court does not regard as adequate given the fact that most or all of the defendants are overseas and likely have language barriers. (The Court typically requires a 7 day interval at a minimum.) The Court therefore denies the motion for preliminary injunction [25], without prejudice. The ex parte TRO will expire by its own terms on 2/2/2026 and will not be extended by the Court.
