PAPERLESS ORDER Granting, in part, Defendants' [52] Motion to Compel Plaintiff to Provide Complete Responses to Interrogatories and Requests for Production and for Sanctions under Rule 37(a). Plaintiff's [59] Response to the Motion represents that in an effort to resolve the Motion, Plaintiff amended its discovery responses to withdraw or narrow its "generalized objections" and served them upon Defendants. (ECF No. [59] at 4). Plaintiff's counsel represents that no other documents responsive to Defendants' requests exist, and everything on which Plaintiff will rely has been produced. In this respect, the Motion is moot and is denied as such. To the extent Defendants' Motion seeks an Order overruling Plaintiff's general objections remaining in Plaintiffs' amended responses, including a general objection to any request on the purported basis that the request may call for the production of privileged materials, the Motion is GRANTED and Plaintiff's general objections are disregarded. Defendants' Motion finally seeks an Order shifting fees incurred in pursuit of Plaintiff's amended responses, pursuant to Federal Rule of Civil Procedure 37(a)(5)(A). The Court must shift the costs incurred in bringing a motion to compel when that motion is granted or discovery is produced only after the motion is filed, unless the objections to discovery were substantially justified or an award would be unjust. Fed. R. Civ. P. 37(a)(5)(A). As noted in open court, the objections were withdrawn and not substantially justified. Accordingly, an award of fees is required unless the award would be unjust. During the hearing, Plaintiff's counsel disputed Defendants' entitlement to an award of fees. If after 14 days from this Order a dispute persists, Defendants shall serve (not file) Plaintiff with the documentation supporting their demand for the fees they seek under Rule 37. If the Parties have still not resolved this dispute by January 5, Defendants may file a memorandum of no more than 5 pages explaining their demand for fees to be shifted on this Motion. Plaintiff shall respond by no later than January 12, 2026, explaining their position on Defendants' demand.
