MINUTE entry before the Honorable Thomas M. Durkin: Plaintiff's motion for expedited third-party discovery 18 is granted. Plaintiff argues that it requires discovery from third-party e-commerce platforms to determine whether Defendants have sold products in Illinois in order to establish that the Court has personal jurisdiction over Defendants. Plaintiff is the owner of a registered trademark, and Plaintiff alleges that Defendants use a similar mark on their products. Plaintiff also alleges that Defendants sell their products on the internet, presumably making them available for sale in Illinois. This is a "colorable" showing of personal jurisdiction that is sufficient to justify expedited third-party discovery. See Cent. States, Se. & Sw. Areas Pension Fund v. Reimer Express World Corp., 230 F.3d 934, 946 (7th Cir. 2000). Plaintiff's motion to withdraw its motion for temporary restraining order 17 is granted. Plaintiff's motion for electronic service of process 19 is denied without prejudice. If Plaintiff discovers evidence supporting the Court's exercise of personal jurisdiction, Plaintiff can refile a motion for leave to serve process electronically.
