Tharp, Jr: Upon review of the plaintiff's supplement [11], a substantial majority of the defendants named in this suit (26 of 36) were defendants in another recent suit (25-cv-698) which was voluntarily dismissed after the court denied the motion for a temporary restraining order. The civil cover sheet response to question X, however, answers "no" in response to whether this case has been previously dismissed. These tactics raise the specter of forum shopping: filing a claim, dismissing that claim in the face of an adverse ruling, and then filing a new suit that presents the same claim before a different judge. If the plaintiff wishes to pursue a claim against the defendants previously named in 25-cv-698, that claim should be reasserted in the original case, if still pending, or the designation sheet should be properly completed to inform the Clerk that the new case involves the same parties and same subject matter, so that the case is reassigned to the original judge pursuant to Local Rule 40.3(b)(2).
