ORDER REGARDING MOTION FOR PRELIMINARY INJUNCTION, signed by the Honorable Matthew F. Kennelly on November 9, 2025: For the reasons stated in the attached order, the Court grants the motion for preliminary injunction as to all of the defendants remaining in the case other than the 9 purportedly represented by Medouki. The Court will separately enter a preliminary injunction order regarding the non-Medouki defendants. As to the 9 purportedly represented by Medouki (abdellaha-61, altosra0, aziza-54, handcraft-0, khaelo-15, mashoulha_0, mohrahm_47, rhassane_0, and samihf0), the Court hereby extends the initial TRO to November 18, 2025, based on a showing of good cause to allow Medouki to provide evidence to support his ownership of these entities as a sole proprietor and to allow ELO to supplement its request for a preliminary injunction against them. Medouki's submission and ELO's submission (which is limited to 8 pages) are both due by November 12, 2025. Kennelly: The motion by Dalil Medouki, who identifies himself as the sole proprietor of several defendants in this case, to participate in hearings by telephone is granted, as the Court intends to hold all hearings by telephone in this case (for everyone, not just Mr. Medouki). Mr. Medouki's request to dissolve the temporary restraining order based on the first sale doctrine is denied because his contention that his sales are protected by this doctrine is not supported by any evidence. The Court directs plaintiff's counsel to reach out promptly to Mr. Medouki to confer to attempt to reach a resolution.

MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for leave to file certain documents under seal [8] is granted, but its request in the same motion to proceed temporarily under a pseudonym is denied. Plaintiff has not made the case that it will be prejudiced unfairly by filing the lawsuit under its own name. The Court notes in this regard that literally dozens of cases similar to this one are filed in this district every month, at least 98 percent of them under the plaintiffs' names, without any apparent or appreciable problem. Plaintiff's motion relies in part on particular events that took place well over two years ago in unrelated matters that appear to involve different plaintiffs. In the Court's view, good cause for proceeding under a pseudonym has not been shown.
