Kennelly: The Court's 9/19/2025 order in this case entering a TRO made it clear that it would deny any motion for preliminary injunction if plaintiff failed to serve the defendants with summons and the complaint sufficiently before the 10/3/2025 preliminary injunction hearing for fair notice. Plaintiff did not serve the summons electronically until today (9/30/2025) and filed a motion for preliminary injunction at the same time. That is insufficient notice. The Court denies the motion for preliminary injunction [29]. At the Court's instance, the ex parte temporary restraining order entered by the Court on 9/19/2025 is extended through 10/17/2025. The telephonic preliminary injunction hearing set for 10/3/2025 is vacated and reset to 10/17/2025 at 8:55 AM, using call-in number 650-479-3207, access code 2305-915-8729. Any renewed motion for preliminary injunction must be filed by 10/14/2025. In addition, on 9/30/2025 the Court received an email communication to its proposed order email address from a person identifying himself as the owner of the defendant store KUDRION. This individual advised that the store made 50 sales of the allegedly infringing product for total revenues of 300 dollars; made no profit; is no longer selling the items in question; and claims significant harm from the temporary restraining order/preliminary injunction. This individual asked for advice on how to oppose the motion for preliminary injunction and instructions in Chinese (neither of which the Court is able to do) and said that he/she could not participate in the preliminary injunction hearing. The Court directs plaintiff's counsel to promptly reach out to this particular defendant (store KUDRIOD; email address axiangs9527@gmail.com) to attempt to reach an accommodation and also directs plaintiff's counsel to file a status report regarding this particular defendant on 10/10/2025.
