PAPERLESS ORDER GRANTING 6 Motion for Leave to File Temporarily Redacted Verified Response to our Schedule "A" Order (the "Motion"). In the Plaintiff's view, "filing an unredacted version of the verified response would prematurely disclose the Plaintiff's identity on the public docket, defeating the purpose of sealing and potentially alerting infringers prior to entry of injunctive relief." Mot. at 2. There is a strong presumption in favor of public access to court records. See Chi. Tribune Co. v. Bridgestone/Firestone, Inc., 263 F.3d 1304, 1311 (11th Cir. 2001) ("Beyond establishing a general presumption that criminal and civil actions should be conducted publicly, the common-law right of access includes the right to inspect and copy public records and documents."); S.D. Fla. L.R. 5.4(a) ("Unless otherwise provided by law, Court rule, or Court order, proceedings in the United States District Court are public and Court filings are matters of public record."). To overcome this presumption of public access, the Plaintiff must show "good cause" to seal, "which requires 'balancing the asserted right of access against the other party's interest in keeping the information confidential.'" Romero v. Drummond Co., Inc., 480 F.3d 1234, 1246 (11th Cir. 2007) (quoting Chi. Tribune, 263 F.3d at 1309). "A party's privacy. sometimes overcomes the interest of the public in accessing the information." Ibid. We find good cause to allow the Plaintiff to temporarily redact its response here. We therefore authorize the Plaintiff to: (1) file a redacted version of the verified response publicly, omitting the Plaintiff's name and identifying information; (2) file an unredacted version of the verified response under seal; (3) maintain the redactions temporarily until we resolve the Plaintiff's forthcoming "Motion to Seal and pseudonym[.]" Mot. at 2. We add that "[n]o-name litigation is disfavored in general," Kay v. Individuals, Partnerships & Unincorporated Associations Identified on Schedule A, 2023 WL 5333110, at *2 (S.D. Fla. Aug. 18, 2023) (Bloom, J.) (quoting XYZ Corp. v. Partnerships & Unincorporated Associations Identified on Schedule A, 2022 WL 180151, at *1 (N.D. Ill. Jan. 20, 2022)), and that a complaint "must name all the parties," Fed. R. Civ. P. 10(a). "The rule does not merely further administrative convenience--it protects the public's legitimate interest in knowing all of the facts involved, including the identities of the parties." In re: Chiquita Brands Int'l, 965 F.3d 1238, 1247 (11th Cir. 2020) (cleaned up). Since the Eleventh Circuit has recognized a "narrow exception" to that rule in "exceptional cases," ibid.
