ORDER: Although the Court grants the motions for expedited discovery and electronic service of process 13 14 given the need to obtain information for the provision of reasonable notice, the Court does express doubt on whether the design patent was infringed given the dissimilarities shown in R. 13 at 4-5. Only ornamental features may be protected by design patents, and the basic similarities appear to be functional features of this type of product (e.g., waist cinchers must have some type of band that folds over the front of the body, and the shapes and parts that fasten do not look the same). In any event, the pending motions are appropriate to grant to get the case started. The tracking status hearing of 08/22/2025 is reset to 09/19/2025 at 8:30 a.m., but to track the case only (no appearance is required, the case will not be called).
