MINUTE entry before the Honorable Martha M. Pacold: Plaintiff's motion to reconsider, 10, is denied. Plaintiff's motion argues that the court's order denying the request for a temporary restraining order, 7, overlooked Exhibit B to its complaint, [2-2], which it argues establish personal jurisdiction over defendants. However, Exhibit B was stricken from the docket as improperly filed under seal without leave of court, 8, and thus was not properly before the court and thus could not be used as the basis for a finding of personal jurisdiction. Although plaintiff has now filed an unsealed copy of Exhibit B, see [10-3], "[a] party may not use a motion for reconsideration to introduce new evidence that could have been presented earlier." Oto v. Metro Life Ins. Co., 224 F.3d 601, 606 (7th Cir. 2000). Moreover, the court notes that plaintiff's Schedule A, [2-1], was also stricken, 8. The absence of any properly-filed list of defendants in this case means that there are currently no defendants for the court to enjoin, which provides an independent basis to deny a temporary restraining order. See Fed. R. Civ. P. 65(d)(2) (defining those bound by a temporary restraining order in terms of the parties).
