MINUTE entry before the Honorable John Robert Blakey: Plaintiff seeks to sue 198 separate defendants for copyright infringement, see 1, 2. Joinder of multiple defendants in a single copyright infringement action remains appropriate only if the claims against the defendants are asserted "with respect to or arising out of the same transaction, occurrence, or series of transactions or occurrences," and a common question of law or fact exists as to all defendants. Fed. R. Civ. P. 20(a)(2)(A)-(B). In this regard, Plaintiff alleges that the "Defendant Internet Stores share unique identifiers, such as design elements and similarities of the unauthorized products offered for sale, establishing a logical relationship between them and suggesting that Defendants' illegal operations arise out of the same transaction, occurrence, or series of transactions or occurrences." 1 at 7. But this is a legal conclusion, which the Court need not accept; nor does the allegation support joinder, as it is equally possible that each online retailer set up shop in the same or similar manner. See, e.g., Estee Lauder Cosms. Ltd. v. Partnerships & Unincorporated Associations Identified on Schedule A, 334 F.R.D. 182, 188-89 (N.D. Ill. 2020). Moreover, the screenshot evidence attached to Plaintiff's submissions undermines this allegation: it shows that, although several sellers do appear to be selling the same or similar products, see, e.g., [16-2], others are not, see [16-1] at 1-25; [16-8]. The Court thus finds that Plaintiff has failed to support the joinder of 198 separate defendants in this single action and dismisses the complaint 1. If Plaintiff can, consistent with its obligations under Rule 11, amend its complaint to allege facts to support the joinder of all defendants in this single action, it may do so by 6/6/25. If Plaintiff fails to comply, the Court will dismiss this case. For now, the Court denies Plaintiff's motion for an ex parte temporary restraining order 14 and denies as moot Plaintiff's motion leave to file excess pages 13. The Court grants Plaintiff's motion for leave to file under seal 12, however, and, if Plaintiff amends, it may file its amended complaint under seal as well, if appropriate. Mailed notice.
