Chang: On review of the supplement memorandum, R. 24, the Plaintiff adds that there is a likely copyright infringement of the Plaintiff's "happy face" image with the word (and coloring and font) Nirvana. That claim is much, much stronger than the trademark claim. As it is, the trademark claim seems to assert thatwithout any apparent limitation to any particular font, style, or colorthe word "Nirvana" on its own supposedly designates the music group as the source of the category of clothing. The Court remains skeptical of the validity of a trademark of that religious-based term. In any event, the Court orders the Plaintiff to amend the complaint to add a copyright-infringement claim, which will be a much firmer basis for relief. The Second Amended Complaint shall be accompanied by a new motion for TRO (and a new proposed order). The filings are due on 04/17/2023. The tracking status hearing of 04/07/2023 is reset to 04/21/2023 at 8:30 a.m., but to track the case only (no appearance is required, the case will not be called). Emailed notice
