MINUTE entry before the Honorable Edmond E. Chang: (1.) The Plaintiff has filed a utility-patent infringement action against 14 Defendants, R. 1, 3. But the Court raises the propriety of joinder of the Defendants. The Plaintiff shall review the opinion in Estee Lauder Cosmetics Ltd. v. Schedule A, Case No. 19-cv-7878, 2020 WL 433870 (N.D. Ill. Jan. 27, 2020), and file a supplemental memorandum addressing the propriety of joinder by 07/10/2024. In lieu of the supplemental memorandum, by the same deadline, the Plaintiff may file an amended complaint with (a) one defendant or (b) a subset of the defendants along with a memo explaining why joinder of those defendants is proper. (2.) On review of the motion 2 to seal, it is not apparent why the Plaintiff believes that the Defendants have gone "to great lengths," R. 1, para. 15, to conceal their identities, or what is the basis to conclude that they would destroy evidence or transfer assets, R. 2 at 1. It is one thing to infer in a counterfeit trademark or copyright case that online sellers are knowingly violating trademark or copyright laws, and thus operate with false identities or would otherwise destroy evidence or evade judgments. It is quite another to infer that a utility-patent infringement case involves defendants akin to counterfeiting defendants. The motion 2 to seal is denied without prejudice to filing a more fulsome motion by 07/10/2024. If sealed information is needed to justify the motion, then the Plaintiff may file a supplement to the motion under seal for the time being. (3.) The motion 4 for TRO is denied without prejudice. If and when the joinder and sealing issues are sorted out, then the Plaintiff may renew the motion, but the motion must explain more than rely on the current verified complaint, which simply says that the Plaintiff conducted tests, R. 1, para. 13, and believes that the products are infringing. There are no details supplied on why or how the Plaintiff arrived at that conclusion. Also, the complaint is verified by the general manager of the Plaintiff, and the affidavit generally says that he is relying on personal knowledge **and** what he has been told by others. That will not suffice on the likelihood-of-success element for a TRO. Someone with personal knowledge must aver why and how the particular Defendant's infringes the patent. (4.)
