The Court reduced the amount requested significantly. There are approximately 80 remaining defendants who infringed in disparate ways: some by using the term "Rubik" or "Rubik's Cube" and others by using similar shapes or images as the one identified in plaintiff's mark, and so on. It is not reasonable to expect a defendant-by-defendant determination of an appropriate damages award in this particular case given the disparate types of infringement and the number of defendants. As a result the Court has reduced the amount to what it considers the baseline or lowest common denominator given the nature and character of the infringement.
