MINUTE entry before the Honorable Jeffrey I Cummings: This case has been assigned to the calendar of Judge Jeffrey I. Cummings. The motion to withdraw of attorneys Edward L. Bishop, Benjamin A. Campbell, and Sameeul Haque 14 is granted and those attorneys are terminated as counsel for plaintiff. Plaintiff will continue to be represented by attorney Nicholas S. The Court has reviewed the plaintiff's complaint and finds that joinder of 74 defendants is proper at this preliminary stage pursuant to Fed.R.Civ.P. 20(a)(2) and 35 U.S.C. §299. Specifically, plaintiff has submitted evidence establishing that beyond just infringing plaintiff's same patents - which alone is insufficient to establish the propriety of joinder, see Estee Lauder Cosmetics Ltd. v. Schedule A, 334 F.R.D. 182, 187 (N.D.Ill. 2020), - defendants' infringing products are identical, and contain the same claimed components under the same model numbers, and contain the same infringing manuals. Further, no defendants will be prejudiced by permitting joinder at this juncture. See Bose Corp. v. Partnerships & Unincorporated Associations Identified on Schedule "A", 334 F.R.D. 511, 517 (N.D.Ill. 2020). To the extent any defendant appears and objects to joinder, the Court will revisit the issue and is free to sever certain defendants from the case under Rule 21 at that time. And, of course, the Court's finding regarding joinder in this case is not dispositive of the propriety of joinder in any other cases before the Court. If plaintiff intends to seek injunctive relief and/or electronic service of process and expedited discovery, any such motion shall be filed by 3/10/25.
