Defendant's motion to modify the asset restraint 53 is denied as moot for the reasons that follow. On 12/13/2024, Plaintiff filed a motion for preliminary injunction 25. The Court took Plaintiff's motion for preliminary injunction under advisement 28. On 01/05/2025, Defendants filed their appearance, along with a motion to dismiss 32 33. However, Defendants never filed a response to Plaintiff's motion for preliminary injunction. On 01/23/2025, the Court granted Plaintiff's motion for preliminary injunction "against all non-appearing Defendants" and stated that "[a]ll appearing Defendants may file a response. by 02/07/2025" 42. Defendants never filed a response; however, the Court inadvertently neglected to enter the preliminary injunction against them. The Court also notes that the temporary restraining order expired on 12/20/2024 at 6:00 p.m. Accordingly, there is no court-ordered asset restraint currently in place and Defendants' motion to modify the asset restraint 53 is denied as moot. Due to the ongoing discovery efforts among the parties, the Court denies Plaintiff's motion for preliminary injunction against Defendants without prejudice.
