MINUTE entry before the Honorable Steven C. Seeger: The Court reviewed Plaintiff's notice of voluntary dismissal (Dckt. No. [28]). Plaintiff seeks to dismiss the case under Federal Rule of Civil Procedure 41(a)(1)(A)(i) because of related litigation in front of the United States Patent and Trademark Office. See Dckt. No. [28], at 1. Rule 41 permits voluntary dismissal by notice "before the opposing party serves either an answer or a motion for summary judgment." See Fed. R. Civ. P. 41(a)(1)(A)(i). But here, Defendants have filed an answer, with a counterclaim to boot (Dckt. No. [22]). So Plaintiff cannot dismiss by notice. Plaintiff can dismiss either by a signed stipulation of dismissal, see Fed. R. Civ. P. 41(a)(1)(A)(ii), or with a court order, see Fed. R. Civ. P. 41(a)(2). To receive an order from this Court, Plaintiffs would have needed to file a motion for dismissal, not a notice of dismissal. So Plaintiff should file a motion if Plaintiff seeks dismissal of the action. That said, Defendants seem ambivalent about dismissing their counterclaims. See Dckt. No. [29], at 2 (noting that "Defendant have not yet made a decision" whether they will "agree to dismiss their counterclaims"). What Defendants decide might impact the potential dismissal of this action. "If a defendant has pleaded a counterclaim before being served with the plaintiff's motion to dismiss, the action may be dismissed over the defendant's objection only if the counterclaim can remain pending for independent adjudication." See Fed. R. Civ. P. 41(a)(2) (emphasis added). That said, in light of Plaintiff's attempted dismissal of their claims, a TRO is not necessary. The Court hereby grants Defendants' motion to vacate the TRO (Dckt. No. [25]). The TRO is vacated. As an aside, the Court does not see a receipt of the required bond anywhere on the docket, so the lack of bond more than 7 days after the TRO was granted would be an independent ground for vacating the TRO. The Court directs the parties to discuss settlement in good faith, and with a sense of purpose, and file a status report within one week of entry of this Order. Mailed notice.
