As an initial matter, although Plaintiff's Amended Schedule A names seven defendants, Defendant Guangzhou Colorful Park Animation Technology Co., Ltd is named twice, as Defendant Nos. 172 and 173. Plaintiff should confirm and provide evidence showing that Defendant Nos. 172 and 173 are indeed two different defendants from which Plaintiff seeks statutory damages.Plaintiff is requesting an award of $100,000 from each defaulting defendant. When determining an appropriate award of statutory damages, courts often consider factors such as available monetary data related to the infringement, the defendant's willfulness, and deterrence to the defendant and the public. See UL LLC v. Am. Energy Prods., LLC, 58 F. Supp. 3d 753, 754 (N.D. Ill. 2019) (Kennelly, J.); Sara Lee v. Bags of New York, Inc., 36 F. Supp. 2d 161, 166 (S.D.N.Y. 1999). In its motion, Plaintiff discusses the permissible dollar range of statutory damages and references the amount awarded in one out-of-district case but fails to demonstrate how any factors the Court may consider in determining an award of statutory damages apply to the instant case. Plaintiff is directed to show this Court why the requested damages amount of $100,000 per defaulting defendant is appropriate in this specific case.
