MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff has moved to vacate the Court's judgment dismissing the case for want of prosecution. Plaintiff failed to file a required status report and then, separately, failed to appear for a status hearing. The Court was justified in dismissing the case. In seeking to vacate the judgment, plaintiff does not offer a particularly good excuse: he says that counsel was traveling and forgot to make arrangements to cover the case. That might explain the failure to appear, but it does not explain the failure to file the status report, which could have been done early if plaintiff's counsel was going to be away on the due date. Plaintiff's counsel also cites obsolete, and no longer controlling authority, for the proposition that an advance warning is required before dismissing a case for failure to prosecute. A later Seventh Circuit decision, Fischer v. Cingular Wireless, LLC, 446 F.3d 663, 665 (7th Cir. 2006), discusses the point at length and makes clear that there is no rigid rule requiring an advance warning. The Court nonetheless exercises its discretion to vacate the judgment and reinstate the case. But here is the warning for plaintiff and counsel: if either of them misses any date or deadline from here on in, the case will again be dismissed, and there will be no third chances. An in-person status hearing is set for 4/15/2025 at 9:30 AM. Counsel must appear at that date and time. The deadline for plaintiff to file any motion for default judgment as to the remaining defendants is 4/11/2025.
