The document was filed by an attorney who has not filed an appearance form, as required by Local Rule 83.16. Furthermore, the motion was brought by "defendant" "GRAB-A-DRESS," which is a name utilized by plaintiff as a pseudonym ("seller alias") for the actual legal entity is alleged to be using the online store to violate plaintiff's intellectual property rights. The Court allows plaintiffs to proceed in this manner because plaintiffs allegedly being damaged by such internet stores have no way of ascertaining the legally recognized owners and so would otherwise have no legal mechanism for vindicating their rights. The Court requires plaintiffs to amend their pleadings to reflect the true names of the owners of such stores whenever they are able to do so. Counsel for the defendant designated "GRAB-A-DRESS," however, has no such need for the use of a pseudonym, as counsel is aware of the client's identity. Another ground for striking the motion, therefore, is the failure to identify the client. If counsel enters an appearance, the form must reflect the client's identity, whether an individual, corporation, or other legally recognized entity. Once a proper appearance has been filed, counsel may file a renewed motion for extension of time.
