MINUTE entry before the Honorable Jeremy C. Daniel: Defendant Gibelle's and Mitovilla's motion for reassignment and consolidation [133] is denied. These defendants seek to consolidate cases brought by the plaintiff against them asserting various copyrights. While the cases are of the same ilk, they involve different copyrights and accused products, each of which have issues of law (e.g. whether each copyright is valid) and fact (e.g. whether each accused product infringes the copyright). Therefore, the Court finds that reassignment and consolidation are not appropriate. Mailed notice.

MINUTE entry before the Honorable Jeremy C. Daniel: The plaintiff's motion to stay pending interlocutory appeal [144] is denied. In dissolving the preliminary injunction previously entered in this case, the Court held that "There is no evidence in the record of any creativity on the photographer's part. At this point, the record does not establish the necessary originality to warrant copyright protection. As a result, the plaintiff has not shown a likelihood of success on the merits with respect to the first element of his copyright infringement claim." (R. 96 at 3.) That is the issue on appeal, whether the plaintiff met its burden of showing a likelihood of success on the merits. Contrary to the plaintiff's assertion, the Court did not find the asserted copyright invalid. Rather, the Court's order left open whether the plaintiff could come forward with sufficient evidence to establish that the asserted work is copyrightable. (See R. 96 at 3 ("On the one hand, you have the photographer's generic claims concerning his artistic and technical choices. Those claims do not explain what decisions, if any, he made concerning framing, perspective, lighting, angle, shading, or focus.").) The Court sees no reason to delay the parties' efforts to develop the record and work toward a decision on the merits. The parties shall file a status report on or before April 11, 2025, that addresses the status of the pleadings, identifies any pending motions, proposes a discovery schedule, and identifies any issues that require the Court's attention. The status report should also address the anticipated length or trial and the parties' availability for trial in the first half of 2026. Mailed notice.
