Aspen: In response to our order directing Plaintiff to either show cause as to why the case should not be severed for misjoinder or file an amended complaint [Dkt. No. 15 ], Plaintiff filed its First Amended Complaint [Dkt. No. 16 ]. The First Amended Complaint names two defendants [Dkt. No. 17 ], but the allegations regarding joinder have remained unchanged. For the reasons provided in our prior opinion [Dkt. No. 15 ], these allegations are insufficient to support joinder. Accordingly, we will allow Plaintiff to proceed against only one of the two defendants. Plaintiff shall submit a second amended complaint naming a single defendant by December 3, 2021.
