MINUTE entry before the Honorable Steven C. Seeger: Plaintiff's counsel did not file a response to the motion to vacate and motion to dismiss (Dckt. No. [56]), for whatever reason. And worse yet, Plaintiff's counsel did not include an index for the 1,000+ pages of screen shots that accompanied the Pallett Declaration, meaning the screen shots showing the websites of each of the 182 Defendants. And the pages were not searchable, either. So, when this Court wanted to see the page showing the website of Defendant Sell Costume (meaning 1 of 182 Defendants), this Court was left to look for the screen shot of the website on its own, by searching through over 1,000 pages of screen shots, which were difficult to read and were not searchable. The lack of a response, the lack of an index, and the lack of searchable documents created the need for an Easter Egg Hunt of the worst variety. This Court had to look through over 1,000 pages, one at a time, to find the page in question. This Court is more-than-half-tempted to require each of the attorneys to complete a similar exercise, and personally go through the 1,000 pages, one page at a time, and search for a page hand-selected by the Court. Say, a hunt for the page about OuteeforLittleFeet. That exercise would give the attorneys a feel for what they put this Court through. But this Court will stop short of imposing that sanction. Going forward, this Court may take a different approach, and illustrate the principle that what goes around comes around. This incident is another example of Plaintiff's counsel imposing undue burdens on the Court. Mailed notice

Defendant points to the need for service under the Hague Convention, but this Court already ruled that there was a sufficient basis for service by alternate means. Service under the Hague Convention isn't a viable option when the address of the party is unknown, as Article 1 of the Hague Convention makes clear. Service by publication and by email was a sufficient means to give Defendant notice of the lawsuit. Defendant also moves to dismiss based on a lack of personal jurisdiction. To the extent that the motion purports to be a motion to dismiss, it is late, and defendant did not request or receive permission from the Court for a later filing. So it is denied on that grounds, too. In any event, Plaintiff offered a screen shot of Defendant's website, which provided a sufficient basis for personal jurisdiction. (Dckt.
