MINUTE entry before the Honorable Matthew F. Kennelly: Defendant HAOCHEN has filed a motion to vacate the default judgment order entered against the defendant. It appears from the docket that HAOCHEN did file an answer to the complaint, after the motion for default judgment was filed but before the Court entered the default judgment. The Court overlooked this when it entered default judgment against HAOCHEN. Even though the answer to the complaint may have been filed late, the Court would not have entered default judgment against HAOCHEN had it realized the defendant had filed an answer. For these reasons, the Court grants HAOCHEN's motion 55 and hereby vacates the default judgment entered on 12/19/2021 (dkt. no. 54) to the extent it concerns HAOCHEN. The default judgment remains in effect as to all other defendants. Plaintiff is directed to attempt to contact HAOCHEN and is directed to file a status report on 1/5/2022.
