MINUTE entry before the Honorable Rebecca R. Pallmeyer: In a January 28, 2022 ruling, the court denied Plaintiff's motion to enforce a settlement agreement with Defendant MattVIggo [62]. The court's ruling noted that on December 20, 2021, Plaintiff had explicitly rejected the proposal that Defendant made on December 16, and that Plaintiff claims to have accepted on January 4, 2022. Now asking for reconsideration, Plaintiff asserts that its December 20 e-mail was not a rejection of Defendant's December 16 proposal, but was instead intended to reject an earlier proposal that Defendant had made. Plaintiff claims it was unaware of the December 16 proposal, which had found its way into spam. Defendant is not responsible for the mis-directed e-mail, and Plaintiff has not suggested otherwise. Instead, Plaintiff suggests that Defendant's December 16 proposal had no formal expiration date--meaning, Plaintiff appears to suggest, that it could be accepted at any time. True, Defendant's message did not use the word "expire," but it did say, "Please let me know if you accept our ___ settlement offer before December 17." A fair reading of that language is that Defendant intended to keep the offer open until the next day, not for two weeks. The court stands by its decision denying Plaintiff's motion to enforce the agreement. The motion for reconsideration [[63]/[64]] is denied.
