Plaintiff's motion for a temporary restraining order (Dckt. No. 14) is hereby granted. Order to follow. Plaintiff cites the wrong standard for a temporary restraining order, claiming that it needs to show a "better than negligible" chance of success on the merits. As the Seventh Circuit recently made clear, a "better than negligible" chance of success is not enough. See Illinois Republican Party v. Pritzker, 973 F.3d 760, 763 (7th Cir. 2020). Plaintiff's counsel should take note, and make sure that they do not cite the wrong standard in any future case. Also, Rule 65(b)(2) requires a temporary restraining order to state the "hour" that it was issued. See Fed. R. Civ. P. 65(b)(2). Plaintiff's draft order overlooked that requirement. In any future case, Plaintiff's counsel must submit a draft order that complies with Rule 65. Mailed notice.
