After careful consideration of the parties' written and oral arguments, the Court agrees that plaintiff has an adequate basis for an asset freeze but disagrees with the amount of assets that plaintiff asserts should be frozen. As it is unclear what Soufeel's profits were from the sales of the alleged infringing products, this Court orders that Soufeel shall be temporarily restrained and enjoined from transferring or disposing of $132,812.69 (which represents the amount of sales of the alleged infringing products identified to date). Accordingly, Soufeel's motion to unfreeze assets 36 is granted in part and denied in part. Plaintiff's motion for entry of a preliminary injunction 29 has been taken under advisement. Mailed notice.
