MINUTE entry before the Honorable Manish S. Shah: Defendant Lifeng Mall's motion to vacate judgment 67 is granted. Plaintiff argues the motion is untimely, by reference to Rule 60(c)(1), because it was filed more than one year after judgment. But defendant relies on Rule 60(b)(4), and through its silence and omission, plaintiff concedes that there is no time limit to a Rule 60(b)(4) motion. Philos Techs., Inc. v. Philos & D, Inc., 645 F.3d 851, 857 (7th Cir. 2011). Defendant says it never sold any product into Illinois and plaintiff responds with a screenshot showing that someone could type an Illinois address into a website when placing an order with defendant. Plaintiff does not offer evidence that it followed through on the order depicted, received a product in Illinois, or consummated a transaction only to have it later canceled by defendant. See [71-2] at 11-14 (showing order at the "place order" stage, but before payment was accepted). Unlike cases where an online seller confirms that it reaches into Illinois by accepting a transaction, if the only evidence is that plaintiff can type the word Illinois into a website without confirmation, then plaintiff falls short of even a prima facie showing of defendant's purposeful availment of Illinois. Cf. Manchester United Football Club Ltd. v. Partnerships & Unincorporated Associations Identified on Schedule A, No. 24 CV 5692, 2024 WL 5202272, at *5 (N.D. Ill. Dec. 23, 2024). The judgment against Lifeng Mall is void for lack of personal jurisdiction, and the court vacates the judgment accordingly. The court does not reach the question of service-of-process. The plaintiff's written submissions establish that if defendants were informed of this proceeding before a TRO could issue, assets would likely be redirected, defeating plaintiff's interests in identifying defendants, stopping the infringement, and obtaining an accounting. In addition, the submitted evidence establishes a strong likelihood of success on the merits (including evidence of active infringement of plaintiff's intellectual property and sales into Illinois), the harm to plaintiff is irreparable and an injunction is in the public interest because infringement interferes with the plaintiff's ability to control its marks. Those rights cannot be fully compensated by money damages. There is no countervailing harm to defendants from an order directing them to stop infringement. Electronic service of process does not violate any treaty and is consistent with due process because it is an effective, perhaps the most effective, way to communicate with defendants. The court has doubts about the propriety of joinder and whether plaintiff genuinely intends to pursue an accounting (justifying an asset freeze), but at this preliminary stage the court is persuaded that plaintiff has sufficient indicia of coordinated activity and prospect of an accounting to justify the requested relief as to all defendants. Expedited discovery is warranted to identify defendants and implement the asset freeze. If any defendant were to appear and object, the court will take a fresh look at the asset freeze and joinder. A $10,000 bond is sufficient to secure the injunctive relief. Enter Sealed Temporary Restraining Order. Notices mailed.
