MINUTE entry before the Honorable Manish S. Shah: Plaintiff's motion for entry of default judgment [47] is granted. No defendant has appeared or filed any objections to the motion. The evidence submitted in support of the preliminary injunctive relief and defendants' failure to defend the case establish liability and justify the award of permanent injunctive relief to prevent future infringement. The court clarifies that any asset restraint is limited to the amount of statutory damages awarded and supplemental proceedings to enforce the judgment must comply with Fed. R. Civ. P. 69. Defendants are not enjoined from receiving money, but any accounts containing assets up to the statutory damages award are subject to collection. Based on the willfulness of the infringement, the need to deter this type of activity, and the ease with which infringement can occur, balanced against the absence of any showing of lost profits or that these defendants engaged in high-volume infringement, the court concludes that $100,000 is an appropriate award of statutory damages. Enter Final Judgment Order. Terminate civil case. Notices mailed.
