Gettleman on 3/31/2020: Plaintiff Volkswagen Group of America, Inc. filed this lawsuit against a number of entities that plaintiff has preliminarily established were selling counterfeit products with plaintiff's trademark, "Audi," or similar marks. The court allowed electronic service of process pursuant to Fed.R.Civ.P. 4(f)(3) based upon plaintiff's affidavit and supporting materials indicating that plaintiff could not determine the various defendants' addresses because they were located in China and used email addresses to market the infringing products (Doc. [23]). One of those defendants, yhz_68, has filed a motion to dismiss (Doc. [48]) complaining principally about the electronic service of process and invoking the Hague Convention. There is no question that this defendant got actual notice of this case through electronic mail. First, the court is uncertain as to the ability of the person who apparently signed the motion to dismiss, Zhou Yu Hang, to represent this defendant. His or her email address on the pleadings is, "lawsmanslaw@163.com." It is doubtful, as plaintiff points out, that this person is an attorney licensed to practice in this district or this country. In any event, it is clear that the Hague Convention does not nullify Rule 4(f)(3), Nagravision SA v. Gotech Int'l. Tech. Ltd., 882 F. 3d 494, 498 (5th Cir. 2018), and this court is satisfied that electronic service was properly granted based upon plaintiff's previous submissions. For these reasons, defendant yhz_68's motion to dismiss (Doc. [48]) is denied. Mailed notice
