In its Rule 56.1 statement, Burberry established that it is the owner of certain U.S. trademark registrations; that defendant eshopinbox, through its online marketplace account, advertised, offered to sell, and sold products that were identical with or substantially indistinguishable from Burberry's trademarks; that eshopinbox did so without Burberry's authorization; and that eshopinbox's counterfeit products caused a likelihood of consumer confusion. Burberry has met the requirements of Rule 56(a), and summary judgment is therefore entered in its favor. Eshopinbox is ordered to pay one hundred thousand dollars ($100,000) in statutory damages and is permanently enjoined from advertising, offering for sale, and selling products using Burberry's trademarks.
