On review of Amended Schedule A, and the TRO motion, the Plaintiff shall file a supplement to the motion that provides a side-by-side comparison of the screenshot of the allegedly infringing item with the particular infringed design patent (one of the three), and specifically explaining how the non-ornamental features of the online-seller item infringes on the non-ornamental features of the design patent. The supplement is due on 07/15/2024. (2.) On review of the motion [9] to seal, it is not apparent why the Plaintiff believes that the Defendants will destroy evidence or transfer assets. It is one thing to infer in a counterfeit trademark or copyright case that online sellers are knowingly violating trademark or copyright laws, and thus operate with false identities or would otherwise destroy evidence or evade judgments. It is quite another to infer that a utility-patent infringement case involves defendants akin to counterfeiting defendants. The motion [9] to seal is denied without prejudice to filing a more fulsome motion by 07/15/2024. If sealed information is needed to justify the motion, then the Plaintiff may file a supplement to the motion under seal for the time being. (3.) The motion [10] to use extra pages is granted. (4.)
