Jenkins: The Court has preliminarily reviewed the briefs opposing the entry of a preliminary injunction filed by Defendants 3, 4, 5, 7, 9, 11, 13, 17, 30, 81, 82, 83, 86 and 88. It is inclined to grant the motion for a preliminary injunction over Defendants' objection, and to require Plaintiff to post a bond in the amount of $250,000 pursuant to FRCP 65(c). The Court agrees that Plaintiff's patent and trade dress are not as narrow as Defendants urge, that Plaintiff's trade dress has acquired secondary meaning, and that there is a basis from which to conclude that the accused products are infringing. These conclusions would mean that there is a reasonable likelihood to succeed on the merits such that a preliminary injunction is appropriate. Counsel for the moving Defendants did not comply with the Court's standing Order which requires counsel for the moving party to confer with opposing counsel prior to the filing of all motions and include an agreed briefing schedule. More importantly, counsel for the moving Defendants filed an appearance in the case before a motion to extend the TRO was filed on July 30, 2024, but defense counsel did not object or otherwise take action regarding extending the TRO at that time. The merits of the motion to vacate only addresses likelihood of success on the merits; it does not discuss irreparable harm. Under these circumstances, the Court does not see why vacating the TRO is warranted. Presumably, Plaintiff will file a motion for a preliminary injunction before the TRO expires on August 16, 2024, so the moving Defendants can file their opposition at that time. In the interim, the Court encourages the parties to meaningfully confer about the matters raised in the motion to vacate in an effort to resolve their disputes. Mailed notice
