MINUTE entry before the Honorable Sharon Johnson Coleman: On review of the memorandum in support of joinder 20, and the pertinent exhibit 21 the Court concludes that joinder is proper for the Defendants on Schedule A 2. The trademark in question is a specific piece of unique artwork and the alleged infringers are selling similar, in some case indistinguishable, reproductions of this same image with comparable color alterations and words added. Moreover, the infringing products are all signs or posters, and do not take a wide variety of forms. While it is true that the "sameness of the accused products is not enough to establish" proper joinder, when a unique image is altered in a nearly identical fashion, even by over 100 online retailers, the Court can properly infer that there is some connection between these causes of action. In re EMC Corp., 677 F.3d 1351, 1359 (Fed. Cir. 2012). Despite the large number of Defendants listed on Schedule A, this case may proceed because Defendants' actions are sufficiently connected to warrant joinder. Presentment of Plaintiff's TRO motion is reset for 8/25/2023 at 9:45 AM. Mailed notice.
