MINUTE entry before the Honorable John J. Tharp, Jr:The plaintiff's motion to reinstate Defendants Nos. 63 and 79 45 is denied. Pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i), the plaintiff voluntarily dismissed Defendants Nos. 63 and 79 without prejudice and purported to do so "with leave to reinstate within ten (10) calendar days if the [parties'] agreed settlement payment is not received." 39 The plaintiff alleges the defendants did not pay and thus moves in accordance with its notice of voluntary dismissal to reinstate. However, a plaintiff may not attach conditions to a voluntary dismissal made under Rule 41(a)(1)(A)(i). Such dismissal is self-executing and "automatically terminates the action upon the filing of the dismissal with the clerk." Swedberg v. Marotzke, 339 F.3d 1139, 1142 (9th Cir. 2003). A Rule 41(a)(1)(A)(i) dismissal is "a matter of right running to the plaintiff and may not be extinguished or circumscribed by adversary or court." Int'l Driver Training Inc. v. J-BJRD Inc., 202 F. App'x 714, 716 (5th Cir. 2006) (quoting Am. Cyanamid Co. v. McGhee, 317 F.2d 295, 297 (5th Cir. 1963)). However, "[c]onditional notices of dismissal are not within the scope of Rule 41(a)(1) because 'the clerk will have to construe the condition and perhaps even become a fact-finder to determine when the condition is satisfied. This defeats the purpose of Rule 41(a)(1) to provide a quick, automatic means of ending an action.'" Amore ex rel. Ests. of Amore v. Accor, 529 F. Supp. 2d 85, 91 (D.D.C. 2008) (quoting Hyde Constr. Co. v. Koehring Co., 388 F.2d 501, 507 (10th Cir.1968)). There is, however, nothing precluding a plaintiff from attaching agreed conditions to a stipulated dismissal under Rule 41(a)(1)(A)(ii) or moving to reinstate voluntarily dismissed defendants while its claim is still pending against other defendants. 9 Fed. Prac. & Proc. Civ. §§ 2366-67 (4th ed.). Likewise, a plaintiff may also move under Rule 41(a)(2) for an order of court imposing conditions on a voluntary dismissal. Scam Instrument Corp. v. Control Data Corp., 458 F.2d 885, 889 (7th Cir. 1972). None of those options remain available here, but given that the plaintiff has dismissed Defendants Nos. 63 and 79 without prejudice, it is, of course, free to initiate a new action founded on the same claims.
